Affidavit No. 5119/2009

Sworn Statement

After having been warned to tell the truth and nothing but the truth or else I shall be subjected to penal action, I, the undersigned, „Abd-al-Fattah „Abdallah Sa‟id Abu-„Ubeid, of Palestinian nationality, holder of ID No. 967781337, born on 8 December 1947, a retired employee, and a resident of the Zuqaq al-Masarwa neighbourhood, Jenin city, Jenin Governorate, would like to declare the following:

I live in a two-storey house in the Zuqaq al-Masarwa neighbourhood, which is located near the main roundabout in the centre of the city of Jenin. My brother Bassam „Abdallah „Ubeid, who is 45 years old, married and father of eight children, lives on the first floor. My wife, three children, and I live on the second floor.

At around 1:30 am on Friday, 23 October 2009, I was awake and present in my brother‟s house because his wife was sick while he was away from the house. At that time, I heard the sound of violent strikes on the door of my brother‟s house, so I asked who it was.

“Open quickly. This is the Israeli Defence Army. Everybody get out of the house.” I heard a person reply.
I opened the door. My sister-in-law, her children Tahrir Bassam Abu-„Ubeid (20 years old), Taqi (6 years old) and Nidal (2 years old), and I left the house. As I exited my brother‟s house, I carried Nidal in my arms. The rest of my brother‟s children were not at home that night. I saw approximately 12 – 13 Israeli soldiers dressed in full military uniform with helmets on their heads point their weapons at us. They also pointed torch lights, which were fixed on their weapons, at us, preventing me from accurately seeing them. From a distance of ten metres, they demanded in Arabic that I leave the child, so I put him down on the ground. They also demanded that I remove my upper clothes and take off my trousers, which I did. I took off all my clothes except for my underwear. Very quickly, three Israeli soldiers approached me, held my arms, pushed me against the wall around the house and demanded that I raise my arms, pushing my face against the wall. Without any justification or warning, they started to beat me with their fists, feet and rifle butts on all parts of my body, especially on my back, arms, legs and waist. The strikes were severe and painful. My sister-in-law and the rest of the children were present at a distance of about five metres away from me. They screamed and cried as they watched while I was being beaten. I was beaten for about five minutes.

“Keep silent and shut up!” The soldiers shouted at me each time I wanted to protest.
I was beaten before they asked for my name or saw my ID card. As soon as the Israeli soldiers stopped beating me, I saw the Israeli captain, who is known as “Ayyoub”. He was tall, of strong build, of white complexion, of about 40 years of age, and spoke Arabic fluently. I knew him because he had raided my house and my brother‟s in search of my brother Bassam Abu-„Ubeid.
“Who is this?” The Captain asked the soldiers.
“My name is „Abd-al-Fattah Abu-„Ubeid.” I answered a soldier who asked me.
The captain then ordered soldiers to stop beating me. The captain stood at a distance of about 10 – 15 away from me. Having requested that I come close to him, I protested because I had been beaten.
“You cause yourselves to be beaten.” He literally replied to me.
“Where is Bassam?” He then asked me.
“In the city of Jericho.” I answered.

Later, the captain told me to take my children and wife outside of my house. Soldiers searched my children, examined their IDs, and forced them to sit on the ground near a wall with their hand held up behind their heads. During this time, I saw approximately 12 soldiers raid my house and my brother‟s house. Having searched them for 15 minutes, they got out and left for the asphalt main street, where military jeeps were parked at a distance of about 30 metres away from the house.

“I will visit you again.” Captain Ayyoub told me in a threatening tone.
When we returned to our house, we saw that some of the contents were destroyed because the soldiers had searched the houses in a brutal and savage manner. Later, I went to the Jenin Governmental Hospital and received necessary treatment. Because the Israeli occupying soldiers beat me, I sustained contusions in the left leg and chest as well as scratches on the left hand. I should note that I suffer from heart disease.
